1. Acceptance of Terms
By accessing or using Gewape Cloud Infrastructure ("GCI") services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.
2. Description of Services
GCI provides enterprise cloud infrastructure services including but not limited to: private cloud platforms, distributed storage, container orchestration, and managed infrastructure operations. Services are deployed across our sovereign infrastructure in Kenya, Rwanda, Nigeria, South Africa, Singapore, and Brazil.
3. Account Responsibilities
As a customer, you are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your use complies with applicable laws and regulations
- Notifying us immediately of any unauthorized access
4. Acceptable Use
You agree not to use our services to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Distribute malware or conduct malicious activities
- Engage in unauthorized access to systems
- Send unsolicited communications (spam)
- Host content that is illegal, harmful, or offensive
5. Service Level Agreements
Specific service level commitments, including uptime guarantees and support response times, are defined in separate Service Level Agreements (SLAs) applicable to your service tier. Please refer to our SLA documentation for detailed terms.
6. Data Ownership
You retain all rights to your data. GCI does not claim ownership of any content you store or process using our services. We will only access your data as necessary to provide services or as required by law.
7. Payment Terms
Payment terms are specified in your service agreement. Failure to pay may result in suspension or termination of services. We reserve the right to modify pricing with reasonable notice.
8. Limitation of Liability
To the maximum extent permitted by law, GCI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
9. Termination
Either party may terminate services with appropriate notice as specified in your service agreement. Upon termination, you are responsible for retrieving your data. We may terminate or suspend access immediately for violations of these terms.
10. Governing Law
These terms shall be governed by the laws of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya, unless otherwise agreed in your service contract.
